Backdated Utility Bills and the 18 Month Rule

The Landlord and Tenant Act 1985 (“LTA”) contains provisions which protect tenants. One such provision states that tenants are not liable to pay service charges which were incurred more than 18 months before a demand for payment was served on the tenant.

The case of Burr v OM Property Management Ltd has provided new guidance on the interpretation of s.20B(1) LTA 1985.
