Claims under the Inheritance (Provision for Family and Dependants) Act 1975

 

The County Court has allowed an adult child 'reasonable provision' from her father's estate, continuing the recent trend allowing disinherited children a share of a deceased parent's estate.

In this particular case the deceased had left his entire estate to a friend and had left a letter explaining his reasons for excluding his three daughters. One of the daughters' claimed reasonable financial provision under the Inheritance (Provision for Family and Dependants) Act, asking the court for £59,000 to fund a veterinary training course and to pay off various debts.

The court allowed the daughter's claim but limited it to to £30,000, finding that the estrangement was the daughter's fault.
